CoH/CoV & "Abandoned Servers"

Do the CoH/CoV Servers fall under the "Abandoned Servers" Catagory? I mean there is this quote back from last month... "Now thanks to the US Copyright Office's ruling this week, games that have a single-player component that requires online authentication to access can be modified or copied if the publisher has formally shut down the servers for longer than six months." and the CoH/CoV Servers have definitely been formally shut down for more than six months, there's no denying that... so back to my original question, do the CoH/CoV Servers fall under the "Abandoned Servers" Catagory?

Here's another quote from the 2nd of November at 2:30 PM: "Online games and platforms will continue to attract investment and provide entertainment to millions of gamers, and gamers and preservationists will be able to enjoy appropriate access to video games that no longer are supported by game makers."
