Another long time lurker here.  I played from Beta through to the bitter end on Virtue.  Until recently I have been checking this forum a few times a year in the hopes of reading some good news.  Now I check it daily :) 

So is anyone taking bets on who the Mysterions are?  From what I have read so far it sounds like it is an established dev studio but one that has little or no experience in the MMO segment, a company with strong ties to the gamer community (read: not EA) and a track record of doing the right thing to support gamers and/or devs.  It is apparently a company that will make us all go 'whoa, awesome!'.  My guess is ...

Again, I am not saying that EULAs are categorically non-enforceable. I am simply saying that EULAs are not categorically enforceable. You can't put a clause into a EULA that's not legally enforceable and expect the courts to uphold it just because someone clicked "I Accept". This is coming up more and more because EULAs are getting more restrictive on things that were previously held as "fair use" under the copyright laws.

Your point is entirely valid, but no court is going to say that an explicit license termination clause is invalid and therefore when a game is sold to other providers they must all provide players similar services at no further cost.

Suppose NCSoft sold the software and licenses to 6 other providers and they all opened CoH server farms selling subscriptions -- would a player have a right to have their characters and account assets available on all 6 company's servers?

I really feel like Markus "Notch" Persson is a very valid option.

It has the wow factor.
Little to no history with MMOs.
He has the MONEY an the resources to make it happen.
He's an every gamer kind of dev.
He has the MONEY!
He has the wieght to get his voice heard by a large company.

It just makes a lot of sense to me.

100% confidence in the CHANCE of this deal happening. Well, we all have that do we not? And it has all ridden on NCSoft since day 1. If they don't want to deal, then that's it.

I have zero confidence in this sort of statement thrown out into the ether like this. Someone trying to make themselves look important, is what it usually turns out to be. I'll pay attention when someone CREDIBLE says: "The ink is dry on the transfer paperwork signatures."

Yeah, I agree with you.  And I don't think any big press announcements should be made until the ink is dry, either.  So Massively gets yelled at for taking info directly from this public, gigantic thread, but this Robert guy drags information out of Ironwolf and Team Mysterion (who have repeatedly asked to keep things quiet) and then proceeds to blare it across public Facebook pages and it's fine and dandy?  Why the sudden change of heart from the team when the deal isn't finalized yet?  And what does NCSoft think of all this?

Tony V even showed up in that Facebook post and said the deal isn't final yet.
